Terms and conditions

1. General Terms  

These Terms and Conditions are a legally binding agreement between User and Vendor. The access to and use of this website as well as the purchase of products on chepi.lv are based on the assumption that these Terms and Conditions have been read, understood and accepted by User and User agrees to abide by these and other regulations that regulate the legal relationship between Vendor, User and Consumer as effective in the Republic of Latvia.

If User does not agree to all or part of the chepi.lv Terms and Conditions, he is not allowed to become a Registered User. Use of chepi.lv means that User has agreed to Terms and Conditions entirely, including all changes.  Vendor may amend or update all or part of these Terms and Conditions and other information on the website without any prior notice. Any amendment or update shall be binding as soon as they are published on the website chepi.lv. Vendor has the right to make updates or changes to the products, services or programmes that are available at chepi.lv without any prior notice. Changes to Terms and Conditions that have become effective after the Consumer has made a purchase does not apply to the said purchase. The service shall be provided in accordance to the edition of the Terms and Conditions that was effective at the time of the purchase of the Consumer.

2. Purchase and delivery time

All prices on the chepi.lv online store are in EUR (euro) and include all taxes. The total sum payable includes the price of the goods and shipping costs that are calculated prior to payment. Choosing to pay with bank transfer, it is assumed that the payment time is the day when the payment is received at the Vendor’s bank account.

Every purchase is processed within 2 – 3 working days and dispatched with the delivery service chosen by the Consumer.

During the very busy Christmas period the delivery might take up to 2 weeks. Every purchase is made individually and packed for further delivery. Latvian Post Office can deliver the purchase in a weeks time, depending on the destination of the package. 

3. Payment 

For purchases made on the chepi.lv online store you have the option to pay with VISA (VISA Electron) and MasterCard (Maestro) cards.

4. Delivery 

In general JSC Latvian Post delivers all parcels within Latvia from 3 to 5 working days. Parcel delivery times outside of Latvia are from 5 to 21 working days. Vendor shall dispatch the parcel within 5 to 7 working days from the time of receiving the payment for the purchase and delivery charges. Vendor is not responsible for any delays of delivery that are due to actions of JSC Latvian Post. If the Consumer from the Republic of Latvia has not received the parcel within 15 days of the day of dispatch, they must inform the Vendor by sending an e-mail to chepi@chepi.lv specifying the purchase number and date. If the Consumer from outside the Republic of Latvia has not received the parcel within 21 working days of the day of dispatch, they must inform the Vendor by sending an e-mail to chepi@chepi.lv specifying the purchase number and date. For larger purchases, please, contact us individually at chepi@chepi.lv.

 

5. Warranty and Returns

The right to file a complaint applies to products which are defective according to applicable consumer protection legislation. Any Customer who wishes to assert their right to file a complaint for any product ordered shall contact LTD Sajutu mednieces, as soon as possible after discovering the defect using the contact information set forth on the Website. Complaints made within two months of the time the defect was discovered are always considered to have been made in a timely manner. 
LTD Sajutu mednieces will assume the cost for the return freight for any approved complaints.
Once a product, for which a complaint has been filed, is returned and the complaint approved, LTD Sajutu mednieces will refund the Customer in compliance with applicable consumer protection legislation. LTD Sajutu mednieces strives to do so within 14 days from receipt of the complaint by Customer, but it may be delayed depending on the nature of the product. LTD Sajutu mednieces reserves the right to refuse any complaint if the product, in compliance with applicable consumer protection legislation, proves not to be defective.

6. Confidentiality and personal data security

6.1. By entering your personal data at www.chepi.lv in order to place the order, the person agrees to the processing and storage of the data entered by him/her.

6.2. The person's data processing manager is SIA Sajūtu mednieces (Reg No 40103389326, legal address: Avotu iela 3, Peltes, Siguldas nov., LV-2150, phone +371 29409846; e-mail chepi@chepi.lv ; home page www.chepi.lv).

6.3. The personal data controller SIA Sajūtu mednieces, handling and using technical and organizational data protection measures, will process the Customer's personal data in the amount and in the manner required and permitted by the laws of the Republic of Latvia and the European Union. SIA Sajūtu mednieces undertakes to ensure the protection of your privacy and private data and undertakes not to disclose or transfer your personal information to third parties unless there is a legal basis for transferring data to law enforcement agencies or for the defense of the interests of the company.
Customer data is entitled to be stored, received and processed by www.chepi.lv maintainers - Intelligent Systems and SIA Sajūtu mednieces accounting firm. Payee Card Responsible - Fondy.

6.4. Applicable law: Regulation of the European Parliament and of the Council No 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (27 April 2016) and the Personal Data Protection Law.

6.5. Cherry Picking collects and processes personal data:

6.5.1. what the customer www.chepi.lv has entered for the order processing and fulfillment needs: the buyer's name, surname, contact phone, e-mail, home address (if delivery is chosen through the Latvian Post) or Omniva station address (if delivery is chosen through the Omniva); the name, surname, contact phone number, home/ Omniva station address of the recipient of the goods (if the buyer is not also the recipient at the same time) (if the delivery is chosen via Latvijas Pasts or Omniva);

6.5.1.1. in cases where the website does not work or there are other technical problems, and Cherry Picking makes a manual invoice, the customer must submit the data as specified in 6.5.1 and, in addition, the buyer's personal identification number. The need for a personal identification number is determined by Article 7 of the Law on Accounting of the Republic of Latvia (see here). When paying online, the payment system uses the bank card details for identifiying the purchase , while the manual invoice requires a personal identification number.

6.5.2. cookies (web browsing data) - data on the visit of Cherry Picking homepage (www.chepi.lv) during the last 38 months;
6.5.3. e-mail addresses if the client is logged in and has confirmed his application form for receipt of newsletters in his e-mail.

6.6. The processing of the customer's personal data is carried out solely to ensure the execution of the order or the dispatch of newsletters offered by SIA Sajūtu mednieces. Data is stored for at least 5 years, as stipulated in the Law on Accounting of the Republic of Latvia.

6.6.1. When ordering www.chepi.lv, the customer is not automatically signed up for receipt of newsletters, who can apply by entering an email at the bottom of the www.chepi.lv homepage. If the client no longer wishes to receive news letters, he/he has the right to request the deletion of his / her email from the database by writing to chepi@chepi.lv or by clicking on the option to unsubscribe provided below of newsletters.

6.7. The customer has the right to access his data - to request information about what data, where, how and why we store by writing to chepi@chepi.lv.

6.8. The Seller is not responsible for the accuracy, accuracy and reliability of the information the Client presents in the registration form.

7. Settlement of disagreement and responsibilities of both parties'

All legal disputes related to card processing are handled under Latvian Republic legislation.
All disagreements arising from trade and purchasing must be solved through negotiations. If parties are unable to agree to outstanding issues of negotiations on the way, they need to contact with dispute certified mediators. If both parties are unable to agree, they can submit the case to The Constitutional Court of Latvia

8. Closing regulations

Issues that are not governed by this Agreement, the Parties solve in accordance with the legislation in force. In all other issues not covered by the provisions of this Agreement, the Parties should be guided by the force of the Latvian Republic legislation. Terms are valid from August 1, 2015, changes made on May 25, 2018.
